On November 22, 2016, a ruling by a federal court judge instituted a nationwide preliminary injunction, effectively halting the Department of Labor’s (DOL) proposed modifications to the Fair Labor Standards Act (FLSA). These amendments were scheduled for implementation on December 1, 2016. Consequently, the proposed changes are suspended pending further judicial review.

Given the prevailing ambiguity and to ensure compliance with FLSA regulations concerning employee remuneration, revisions have been made to some of the strategies initially planned for alignment with the anticipated FLSA adjustments. Despite the injunction, we will proceed with our pledge to adjust salaries to meet or exceed the proposed FLSA salary benchmark for exempt employees, starting December 1, 2016. However, adjustments to employees’ exemption statuses (from exempt to non-exempt) will be deferred until definitive direction is received from either the judicial proceedings or the DOL.
